At the Magistrate’s Court Gre.vmouth before Mr W. Meldrum S.M., Maurice Robert Spiers was charged with driving a car in a manner, which having regard to all the circumstances of the case ,was dangerous to Robert McDonald and others on the Seven Mile Road on May 11. After hearing lengthy evidence the Magistrate said the evidence of the three men for the prosecution had been given clearly, and though all witnesses had been ordered out of the Court there had been no contradictions in their evidence. In the first place it seemed quite clear that defendant had come round the corner, at too fast a pace. Twenty-five miles an hour at 7 p.m.. when visibility was not the best, was too fast for that particular corner. He had apparently tried to turn it, and had driven off the road. The evidence of the prosecution that the car had skidded at the bend, and again before reaching the three men, was an indication that he was driving too fast, and that the car was not under proper control. The men had a perfect right to be on the road, and did all they could to avoid an accident. He considered that the charge had. been proved. There was no direct evidence as to the extent of McDonald’s injuries. and the amount of damages would have to be settled later by a civil action. Defendant would he convicted and fined £■">, with Court coeds Cl Is, and witnesses’ expenses £1 11s 9d.
