£BOOO TRUST VALID

MELBOURNE, May 26

.Mr Justice Lowe, in the Practice Court, decided that the trust of £BOOO established by Dame Nellie Melba for the creation of a musical scholarship was valid, independent of the condition that the Conservatorium receiving the gift should be responsible for the upkeep of her grave at Mount Mary.

In her will Dame Nellie Melba stipulated that the sum should be set aside conditionally upon the Conservatorium which received the gift undertaking to keep in order her merorial. She had expressed a wish to be buried a. Mount Mary. Later, however, she desired to be buried beside her father in the Lilydaie Cemetery. The condition attaching to the will therefore, became impossible of fulfilment, and the trustees desire to know if, in these circumstances the trust could be established.

Mr Justice Lowe answered this question in the affirmative.
