DIVORCE REFUSED

EXPERIMENTAL RE'UN. ONS

By Teleguiph —Pei Press Association)

WELLINGTON, May 25. Judgment was given in the Supreme Court to-day by Mr Justice Blair in a divorce action in which, subsequent to a deed of -separation being entered into, there was evidence of the parties hav-i-i'jr made unsuccessful experimental reunions. Tlie petitioner was Isaac Bnty. He founded his petition lor a divorce from his wife, Margaret Baty, on the ground of mutual separation. In giving his decision His Honour said that an unusual course ol procedure had been adopted by the parties aft e r they had entered into the deed ~f -separation i.n 1925. Apparently the parties, although separated and living in different, towns, made more or less a -habit of spending their holidays together. They resumed ordinary marital .relations, and then they parted, the parties returning to their respective occupations. The petition wn- dismissed, wi|h costs, on the lowest scale. His Honour added that the fa-ct remained that the petitioner had alleged mutual separation, and, in his view, .(ihe petitioner had not been -able to establish that. mm ~" ni T
