At the Magistrate’s Court Greymouth yesterday before Mr W. Meldrum S.M., John Rodgers, police constable, of Bi’Unnerton, claimed £l7 6s 9d as general damages, from the Grey County Council. The, claim arose out of an accident which occurred in February last, when the County lorry, driven by Mr Cyril Blumsky, collided with a Chevrolet car, belonging to, and driven by planitiff, near the “wig-wag” at Brunner railway crossing. After hearing evidence the Magistrate said that it appeared to him that there was room to pass if reasonable care had been ■ exercised. The defendant had said that he would not take the risk of going into the gutter, but instead took the risk of hitting the car, and thus he must take the responsibilty. The Brunner ’bus and a petrol lorry hnd both passed the car after the accident, and as the wheels wore turned in they had less space than defendant. The defendant had said that he did not swerve but the evidence had shown that he did. Plaintiff had kept as near to the fence as possible and had actually stopped bis car, He had done everything possible on his part to avoid an accident. Defendant, no matter how slow he was going, had not stopped in time to avert a collision. There seemed no doubt that he had admitted at the time that he was responsible. He the Magistrate, therefore thought that the defendant was responsible and judgment would be allowed for plaintiff in the full amount claimed, viz. £l7 6s 9d general damages, £lO special damages (depreciation), and also witnesses’ expenses £3 10s. solicitor’s fee £4 3s and Court costs £2.
