The United Stages Circuit* Court ot Appeals granted A 1 Capone a writ ol supersedeas delaying his removal to the penitentiary, but denied the gangster bail, forcing him to remain in the county gaol without f§ shortening his later penitentiary sentence until he learns the result o-f-'liis appeal on the .latter sentence-,”' which is to be presented to .the United States Supreme Court at Washington. • Tho Government has requested the Supreme Court to reject an appeal from a three-year sentence on the par* of A 1 Capone’s brptlier, Ralph, who was convicted of failing to pay income .tax.- ..- -.
