TESTAMENTARY CA PACITY • UNPROVEN, o 0 3*<By Telegraph —Per Press Association) WELLINGTON, October 22. . The Court of Appeal this afternoon delivered judgment in the appeal cf Cyril Paul Hunter and Thomas Percy Hunter, trustees ir. the estate of the late Sir George Hunter, which appeal was against the judgment of Mr Justice Reed, delivered last April, in the Hunter will case. The judgment of the court, which was prepared by the Chief justice, Mb Myers, was delivered by Mr Justice Adams, It was that tho appeal should be dismissed, with costs on the high* eat scale. In the course of the judgment. His Honour said: “The onus, of proof of ; testamentary capacity is upon the appellants, and we were unable to come to the conclusion that, in view of all, the circumstances of the case, they have succeeded in. proving testamentary capacity, even on the date of the last codicil.” The Court also held .that, as'the appeal was prosecuted mainly in the interests of the two appellants, the costs must be paid by them personally.
