APPEAL COURT
(fiy Teleyraph —Per Press Association) WELLINGTON, October 3. The Appeal Court yesterday afternoon was occupied hearing the appeal of Mrs Dawn against a judgment of the Chief Justice in a case in which judgment was given against her in favour of Dr Fimllater and Henry Bingham arising from an accident on the Hut-t Road. The accident occurred on November 17, Dr Anna Findlater's car colliding with one driven by a man named Wiggs who subsequently d:ed from injuries. Mis Eva Dwan who was also driving a car on the road, ran into Dr Findlater's car and at a subsequent Supreme Court action the Chief Justice held that the second accident would not have happened if Mrs Dwan had used proper care. He gave judgment for Dr Findlater for £471 9s 6d and for Henry Bingham, a passenger in Dr Findlater's car. who also was injured. for £203. An appeal now is brought from these decisions.
