MAGISTRATE’S COURT

GREYMOUTH, Sept. 8. At the Magistrate’s Court yesterday various charges were dealt with by Air \V. •Aleldnun S ! .AI. ASSAULT CHARGE. Robert Anderson, miner, of Blackball, was charged with assaulting Henry Davies, a storeman, at Blackball on August 28. Henry Davies said that on the day of tire assault he was returning from the Post Office and when passing Anderson, accused had leapt up from where he was sitting and had struck him. Air Aieldrum, S.JI., said the defence wms a denial that the blows were struck but it was admitted that Davies was pushed off the footpath. That was an assault. He was asked to believe that Davies deliberately and without much provocation went out of his way to swing at Anderson. That was improbable. There was no doubt that an assault was committed, but it was not a : serious one. Accused was fined 10s with costs 14s sd, and in default seven days’ imprisonment. OBSCENE LANGUAGE. Anderson was also charged on August 31 with using obscene language, and with using insulting language. Anderson said that he had no clear remembrance of using the words, but as he was drunk, he would not deny it. The words be contended were not used with intent. Anderson was convicted and fined £1 and 16s costs and 14s 5d witness’s costs on the obscene language chaige, and on the other charge ordered to pay costs 10s and witness’s expenses 14s sd. Default was fixed at seven days’ imprisonment. BREACH OF MINING ACT. Frank Tonmny, a miner, of Dobson, was cl larged with a breach of the Alining Regulations in respect to shotfiring under Section 232 of the Alining Act. Charles Hunter, manager of the Grey River Collieries said that he had posted a notice at the mine mouth regarding shot-firing and stating that the cutting side must be six feet in distance. Defendant’s side was only five foot six inches, and the hole was driven right into the rib side instead of being 9 inches distant. The practice was dangerous, and in that case had resulted in a “blow-out” charge. Tomany, who did not appear, was fined £1 with costs. WRONG NAME. AND ADDRESS. Thomas Julian, charged with giving a. false name when caught after hours on licensed premises was fined 10s and costs, and for being on licensed premises was convicted and fined costs 10s. r REMANDED. Frederick James Tibbies was charged with, on August 28, at Stillwater, stealing a yearling bull, valued at £l2, and the property of Kate Aloore. Inspector Holmes asked for a remand to September 11, and said the matter would be dealt with at the next Supremo Court sitting. There Would only be one change but- two cattle would be involved. Bail was fixed in two securities of £2OO. BREACH OF ARMS ACT. Walter Harley was charged with having unlawfully delivered a firearm to an unregistered person, contrary to the provisions of the Arms Act, at Tinwald, on June o. Sergeant C. King said that Harley find given the. pistol, which he had registered, to a friend, and it could not be traced, Harley was convicted and ordered to pay costs 17s, CHARGES OF MISCHIEF. Two charges of mischief were laid against George Shaw, aged 19, miner, of Roa. The first charge dealt with, eight panes in various huts, the property of the Paparoa Coal Co., the glass being valued at £l, and the second concerned goods, the property of Frank Lowe, alleged to have been damaged when one of the window s was broken. The glass * was valued at 10s. Shaw did not appear, but pleaded guilty. Shaw was convicted on both charges, and ordered to nay the damages £1 to the Paparoa Coal Co., and 10s to Frank Lowe, and 2s 6d witnesses’ expenses, and was ordered to come up for sentence if called upon within one year.
