O. F. Nelson and Company wa ß this., day granted leave to appeal against tbe judgment of April 21, and execution was stayed against the .fine of £5,600 which was then imposed. Security on appeal was fixed at £IOO. Tbe company was charged with being in possession of various sums of money amounting to £238 5s paid into the oompuityks office on ’behalf of the Samoan .Men’s Committee, such moneys relating to a native organisation not being of a Teligiou? or charitable nature approved of in writing by the Administrator, contrary to Sec w on 9 |b) of the Maintenance of Authority in Native Affairs Ordinance (No. 2), IP2B. A furthej charge against- the firm viis that on or about August 18, 1930, and on divers -dates botwee.u that date and November 2". 1030. at Apia, they participated in activities of a. seditious organisation, to wit the Man, in that the company did -receive moneys for and on behalf of the said organisation and did issue receipts for the same to members of the c nul organisation contrary to Section 3 (4) of the Samoan Seditious Organisation Regulations, 1930. On gach count there were twentyeigliP charges, making fifty-six charges : ’l. The second series of twentveight charges was withdrawn, but on the first -series the company was convicted and fined £2OO on each of. the twenty-eight counts. In ’summing im. Hi- tud-e. Air Justice ; Luxford, strongly condemned the defendant company. The appeal will be beard in the Supreme Court of New Zealand.
