LOSE APPEAL. (By Telegraph—Per Press Association) WELLINGTON, April 17. In the New Zealand Newspapers Ltd., v. “Sun” Newspapers Ltd., the Court of Appeal this afternoon delivered judgment. The above, case was heard on the 17th ol March. The Court dismissed the application of N.Z. Newspapers Ltd., to have the award otf the arbitrator, Sir W alter | Stringer, referred back to him for reconsideration. j The Chief Justice, in the concluding portion of his judgment, said: “ij | then, it can be said that there was a mistake made bv the umpire, I think , it was a. mistake in regard to the matter within his jurisdiction. and | that being so, upon the authorities that I have cited I am of opinion that the | purchasing Company cannot succeed in jjts-present application. The umpire j does not request the Court to remit the award back to him on the ground of a mistake. He does not admit having made a mistake. Indeed, lie asserts the contrary. For the above reasons the application, in my opinion, fails, and must be dismissed. Judgments to the same effect were delivered by Mr Justice Reed and Mr Justice Smith. Mr Justice Adams and -“•"Mr Justice Ostler concurred in the judgment o£ the Chief Justice, Costs of 100 guineas and disbursements were allowed to the Sun Newspapers, Ltd.
