COURT OF APPEAL
(By Teleyrupli —Per Press Association) WELLINGTON, March 20. The Court of Appeal is hearing Die appeal of N.Z. Bed wood Forests Ltd., versus N.Z. Insurance Co., Ltd., 'lro.ni the judgment of Justice Smith. An originating summons was issued by the Insurance Company last November. stating it was trustee for the debenture holders of N.Z. Forest Ltd. Certain resolutions were passed by a majority of the debenture holders, and the Insurance Coy. souglu a direction as to whether the resolutions were validly passed, and if so, whether the Company should hand over tlie trust Ini a; in the maimer directed by tae resolutions.
.Justice Smith held the resolutions were not validly passed, and the Company as trustee, should hold the trjist 1 11 nds.
Tlie appellants are appealing on both in Inct and in law.
