Judgment in favour of the Rugby Union was given by the Magistrate (Mr T, Page) in the case of Edward Bell . against the Wellington. Rugby Union, a claim for damages in consequence to happenings in a queue to , buy grandstand tickets for the fourth Test against the Britishers. . Mr Page said it was clear that tlie. Union made no express contract with plaintiff to maintain, the order of priority in the queue, and plaintiff, had therefor to rely on the alleged custom. Such custom, in order to become pnrt of the contract,, must be so well known and understood as to be > impliedly incorporated in every contract without the need of mentioning it. “I do not think,’ he said, “there can be held to have been implied in plaintiff’s contract with the defendant Union an agreement or understanding that the latter would throughout preserve the queue in proper order, and-see that thosewho should first take their place in it would he the first to receive tickets. Dealing with the ground that the Union had failed to offer for sale the full number of tickets stated to be available, the Magistrate said‘that he did not think the Union contracted to sell at their booking the full number of 1400 tickets. The statement by the Chairman" that about 1450 tickets would be available was at best, merely an outside estimate, and some reasonable shortage on the amount would not in the Magistrate’s opinion give rise to an action for damages.
