A CLAIM DISMISSED
(By Telegraph—Per Press Association.) WELLINGTON, October 7. Several times William Edward Timmings has ventilated a grievance' in the courts in respect of a transaction which took place, over 22 years ago. Each time lie has been, ruled against At*-the beginning of this month, h started fresh proceedings in the Supreme Court, claiming relief from George Treadgold in connection with the transaction, but again lie has been unsuccessful. In a reserved decision. Mr Justice Ostler said Timmings had no cause of action against the defendant, and entered judgment for defendant, “I trust,” said His Honor, ‘‘that the plaintiff, who is a hardworking man and a useful citizen, will now be able to get this trouble out of his mind and throw no money away uselessly in ligitation in which be cannot hope to succeed.” His Honor added that, in justice to Mr R. H. Boys, who appeared as counsel for plaintiff, he thought lie should mention the fact that counsel not only did not advise the bringing of the action, but clearly advised plaintiff thr the action could not possibly succeed, and that to bring such an-action was a waste of money.
