Mr O’Shea for appelant Corporation, said the land in dispute became a street by virtue of the Municipals Corporations Act, 1867, and ordinances of Canterbury Provincial Council in 1858, 1859, and 1864. The Cathedral Square ordinance passed by the Provincial Council in 1.872, affect any land which had become a street under the Municipal Corporations Act 1867. Section 4 of that ordinance gave the Superintendent of the Province power to clos e the highway then existing over portion of the land in dispute, but he did not do so, and the land has maintained the character of highway down to the present time.,
