BANKRUPTOY PETITION. AUCKLAND, September 26. “Surely a creditor is entitled to withdraw his petition,” said Mr Justice Reed, when counsel for-the debtor submitted, in the Supreme Court to-day, that his client was entitled to be adjudicated a bandrupt. His Honor remarked that he had never heard of suclr a position before. The debtor, an Auckland land agent who was in Wellington, line! sent his counsel a statement to be handed into Court after the order for adjudication was made. To the latter’s surprise, counsel for the petitioning creditor asked that the petiton be withdrawn. The explanation was that the creditor was satisfied that debtor had no estate and no benefit could come from a bankruptcy. At the request of counsel for debtor, the petition, was adjourned on condition that the creditor did not revoke his application for a withdrawal.
