In September last .dJxihii Pereival Smith, farmer, of Kaiwahta, sought a divorce iVoni ( his wife,' Beatrice Smith, on the ground of her misconduct with Archibald McLean. The''petition was dismissed, as Mr Justice Smith found that there had * existed' li conditional agreement that if petitioner, would set his witfe free co-respondent would take her with the farm and children.
When the petition came before Mr Justice Ostler to-dnv, Mr/Meredith for McLean, was granted'.permission to withdraw the defence!-that had been filed. A decree nisi was granted with interim custody of 'the' child to petitioner. -('.le-
