CASE FOR THE DEFENCE
CHRISTCHURCH, April 10
In the libel .action Gooch, (taxidriver) v. the “ Sun,” claims £2OO over, a court report, .evidence was led for the defendant to show that the offending words “.out on the' booze ” had been allowed to appear in one edition only, having been altered in later editions to . out late.” Defendant, it was stated ,had offered to publish an apology, hut this the plaintiff would not accept. Counsel for defendant said the . libel was not disputed, and was the result of an unfortunate blunder, which might easily happen in any evening newspaper. He submitted 1 the amount paid into court, £SO, whs'.an adequate allowance for
damages. The Magistrate ’gave judgement for plaintiff for the . amount paid into court. Defendant was allowed costs.
