LONDON, April 4

McConachy was summonsed by Smith lor using threats, and was bound over till 10th April when he leaves England and was'. ordered to: pay costs. The assault summons was dismissed.

Mr Butlin appearing oh behalf of Smith 'declared McConachy complained on the 24th March that the balls had arrived late. McConachy subsequently made other complaints about the table and also declared his ball was flawed and he was playing under a. disadvantage. The. referee and the manager examined the halls and decided the complaint was unjustified and as McConachy insisted Smith agreed to use the hall himself. Later the New Zealandlander alleged the balls were not nuetral set. Smith agreed to go out and weigh them. The players and the referee engaged a taxi in which McConachy, in vile temper, referred to the allegations. Smith replied: “Jt is a lie”.

McConachy stood up threateningly and cried out “I’ll knock your head off” Smith shouted to the driver to stop, whereupon McConachy knocked him hack in the seat. “I will kill you before I leave Manchester,” shouted McConachy and when the referee attempted to pacify him he added. “Yes and you as well.”

McConsichy’s counsel, Air Rybroft. declared - McConachy simply leaned forward in the taxi and pushed Smith buck in the seat. The words suggested a.s a threatening uttered were only terms of abuse. Smith had acted childishly in calling the police.

McConaohy said lie had evidently put his hands on Smith’s chest. The referee caught his arm and a.s there were two against him he threatened to clean both up. Ho thought the halls were the same weight hut differed in size justifying the complaint.
