marriage proviso DUNEDIN, Nov. 30. Mr Justice Kennedy gave judgment this morning interpreting the will of tne late Thomas John Pearce, who left property to his sister Rebecca with the proviso that, should she ■mlarry, her intieres't ifi the estate should pass to a brother The sister now contemplated marriage, and sought the Court’s direction as to whether the proviso was null! and void.
His Honor’s judgment declared that the proviso was void. He stated that it had long been clear that a condition in genpral restraint of marriage annexed to a gift of personal estate was, nrima facie, void. The authorities expressly stated or impnciily assumed that such a restraining condition was illegal by the rules of the common law.
