MAGISTRATE’S COURT

THURSDAY, OCTOBER 17th

(Before W. Afeldrum, Esq., S.M.) LICENSING ACT.

Charges of being on licensed premises illegally after hours were dealt with as follows:

Two young men (All Nations Hotel, Rimu) who pleaded not guilty were convicted. One was ordered to pay costs 10s and the other fined 20s and costs 10s.

A country resident (Southland Hotel) was ordered to pay costs 10s. Three residents (Keller’s Hotel), one pleaded not guilty and his explanation was accepted and charge dismissed. The other two were fined 20s and costs 10s each.

One country resident' (Alasonic Hotel) fined 20s and costs 10s. F. D. AfcGee (Masonic Hotel! and with giving a false name when interviewed was convicted and fined 10s on the first charge and fined 20s and costs 10s on the second.

For breach of prohibition order an offender was fined 5s and costs 10s. ASSAULT CHARGE.

The Police charged William Singer (Air Eloock) with assaulting W. Bernhard. He pleaded guilty. It was explained that Singer had lost his job as driver of a County lorry .and meeting his successor had an altercation and had struck him. Fined 20s and costs 10s. DEFENCE ACT. F. Saxon was charged with failure to attend parade. Fined 5s and costs 10s. BOROUGH BYE-LAW. Inspector of Nuisances (Mr Park) charged AY. Winacock with driving a motor car on the wrong side of the road. Fined 5s and costs 10s, solicitor 21s. MAINTENANCE ORDER. A. J. Dunn (Mr Murdoch) v. T Dunn failure to pay maintenance order, arrears ’£s. Ordered to pay within three days in default 14 days. DEBT CASES.

Wakelin, claim £1 10s 0. Judgment for plaintiff with costs Bs.

,T. C. Macfarlane (Mr Murdoch) v. L. H. -Morel, claim £lO 15s 0. Judgment for plaintiff with costs 235, solicitor 31s. A COLLISION. L. 0. Ogilive (Air Murdoch) was charged with riding a motor cycle at night in a reckless manner and pleaded not guilty. Leslie Thomas Griffiths was charged with riding a bicycle at night without a light.

Loth cases were taken together. Leslie T. Griffiths gave evidence that he resided at Woodstock. On 21st Rep- j teniber he was riding a bicycle at 8. 30 i p.m., without a light. It was full j moonlight. On the road to Woodstock he heard a motor hike coming behind. The hike crashed into him throwing j him to the ground and putting his j shoulder out. The motor hike and rider also came down. The bicycle was ; not damaged. The motor bike had j the right side of the handle bar broken j off. Witness was on his proper side. ; Ogilvie struck witness on the left side and threw him across the road to the : left. 'Flic motor cvcle went to the left . into blackberries. Witness lost 4 work- . ing days as the result of his injuries. | There was a rear reflector on his | bicycle. | Constable Drummond gave evidence j that ho saw Ogilvie on Sunday night j when he said he had run into Griffiths. I On Tuesday took' statements from Ogilvie and Griffiths. The accident took place on the rise of a small hill. ; It was a clear moonlight night. The right handle bar of Ogilvie’s motor j hike was broken off at the stump. The j road at the point of the accident was : 18 feet wide. 5

To Mr Murdoch—Ogilvie was the first to report the accident to witness. Leslie G. Ogilvie gave evidence he resided at Limit. Tie was riding home . from Hokitika when at a gentle rise j when he got to the top he saw Griffiths ! about five yards ahead. Witness ; swerved to the right and Griffiths also j swerved to the right and witness ; struck him on the right side. Griffiths ; was on the middle of the road.
