Charles A. Tulloch,, The Lake Hotel, Lake Kanieri. Mr Murdoch stated it had not been found possible .to, carry out the requirements of the Committee and lie therefore - wished to withdraw. Application struck out;

George H. Ferguson, Fqrngrove Hotel, Ferguson’s, for removal! .of license. Mr Murdoch for applicant stated owing to the trade passing it was purposed to eventually get the license transferred to Waitaha three miles away, in one mile stages.
Joseph Mnnera gave evidence he was a settler' at , Waitaha. ;He ■ knew G. H. Ferguson was applying for: a. renewal of his license with, a view to removal. The new building was 20ft long a.nd 10ft wide of two rooms. Three or four persons could be put up and if more came they could-'be taken to his (Manern’s) house If miles away. It was their intention to remove the /license ultimately to his (witness) house at Waitaha, which had c-ost over £3009. Had heard of complaints being made of other premises. Would Ibe able to give a meal and other requirements at the temporary prem-
ises. . •* • To the Inspector: He had paid a deposit on an agreement., to buy the license. The new building was under a mile away, on the road reserve. If successful on this occasion at next meeting would apply ior another jump and then later for the third one. The next licensed house was over three miles from witness’s new premises. • Inspector Fitzpatrick stated the police objected to the application, holding it was not made in the spint of the Act. He held the application was made in private, not public interests. The present premises were comfortable ones, and the proposed new premises were an iron shed. . Mr Murdoch held ihe application was simply for a transfer. The question of a transfer was one for .the decision of the Committee. The Committee adjourned at 1 P-™. and resumed at 2.20 p.m., when the Chairman announced that the Comm'ittee bad given careful consideration of the statements brought before them,. but they considered that in the present state of the licensing law that they bad. no power to grant the apnlication before them. They quite admit that if the new premises wore within a mile of the. presen, house that it would be quite a leasbliable request, but they had decided, they had no power to grant the pre-. spnt application and it would be. refused. TRANSFERS.
