PEDESTRIAN SUES MOTORIST. AUCKLAND, Aug. 21. The rights of a pedestrian 011 the road were involved in a claim for damages made by J. G. Jury again&i J. Yankovicli before Mr Levien, S.M.. in the Magistrate’s Court to-day. Plaintiff was awarded £142 damages. The incident leading to the claim occurred in April last. Plaintiff, while crossing Walter’s road at its junction with Dominion road, stopped at the silent policeman, when he was struck by defendant's car, wdiicli was approaching from tne Dominion road tram terminus. After striking plaintiff the car colidecl w’ith a taxicab, wnich wa s cc-ming out of Walter’s road and then struck the rear of an out-w’ard-bouiul tramcar.

It was contended by the defence that a pedestrian had no right to be at that point, but the Magistrate held thn he had that right, athough it was not a wise position for him to occupy. The fact of defendant not seeing plaintiff and subsequent happenings spoke for themselves as evidence of defendant’s negligence. ' .
