The Magistrate found that a case oif defamation had been established.
With regard to the defence, that the, action could not be as the alleged slander arose out of participation of an illegal .'act, namel.v in playing a game of hazards, Mr McNeil said it was decided that in cases which showed' that even, if a man had taken part in an. illegal transaction not to be deprived of all protection in oilier matters concerned with the transaction.
The sum of £ls damages was awarded.
