UNUSUAL ACTION.

PROOF OF REATIONSHIP. " 1 ' ' ‘ PAMERSTON N., May 8. An unusual case was heard in the Palmerston North Supreme Court today before His Ilonur .Air Justice Osier when an action was brought b.y Hugh Le.ydon and his sister, Kate Leydon, both of Ireland, to prove they were respectively brother and sister of a late resident of Levin, who died intestate in 1923. No witnesses appeared in the Court, evidence being taken on commission in Ireland, ancl laid before the Court in the form of affidavits, setting j out marriage dates and relationship of the parties. His Honour made an .order that plaintiffs were lawful brother and sister of James Leydon, deceased. As counsel stated that once the Court had decided the legality of plan i tiffs’ claim, the defendants, Desmond Andrew Leydon and Patrick Joseph Leydon, of Normaub.y, would probably account for the money, no oi-der was made by the Court. Costs were allowed , both parties, to be paid from the estate, and leave was reserved for all parties to apply to the Court for further directions at any time. It was stated during the hearing that the share of each from the estate, which belonged to the late James Leydon, who emigrated from Ireland over fifty years ago, would be about £2OOO.
