■DISCHARGE REFUSED

TIMARU, Alav 2

A bankrupt who thought he could •risk money on the totalisator failed in his application for discharge wien this was brought before His Honor Air Justice Adams in the Supreme Court at Timaru to-day. Applicant was Robert Gould, a labourer, of Ashbur ton. He was represented by Mr L. A. Charles. The application was opposed bv the Public Trustee (AD G. C. Nicoll). Evidence was called, to show that Gould .had acted rightly by all his creditors except the Public Trustee. Jt was stated that he had money with which to pay the Public Trustee, hut had lost this in totalisator investments.

His Honor stated that it was clear the applicant had drawn money to put on the totalisator at both the Ash burton and Timaru races. Air Charles stated that the ofily way bankrupt thought he could getout of his muddle was to bet on Hie totalisator. Probably a period of suspension would sobe-r him up and teach him a salutary lesson. Air Little contended that the applicant lmd wasted his money and lie would ask for a suspension of the order. He understood that bankrupt was buying a house and was negotiating for the of a farm. Air Charles explained that it was not applicant’s money that was being uso d. His wife had been left money and she had put down £2OO on the house.

His Honor .refused the application in the meantime. Continuing, he stated that when n man acted like Haipkrupt. uuddr \such heavy obligation, then it was to be deplored. He 'would have to show repentance and n desire to make good in the discharge of his obligations, and, until that was done the order would be refused.
