At the Alagist rate’s Court yesterday, as the outcome of a fatal accident which occurred at Ogilvie and Co’s sawmill, at Kahikatea on October 23, when Andrew Hell was fatally injured through being knocked down by a locomotive, Louis Lawrence Anderson, who drove the locomotive, was charged with doing so when be did not hold an engine-driver's certificate. William Thomas Ogi'ivio was charged with employing an uncertificated engine-driver. Air •). A\ . Hannan entered a plea of guilty. ATr F. A. Kitchinglinm, who appeared for the prosecution, said that the informations were laid under Section 51 of the inspection of Act. which provided for a penalty being imposed on both the workman and the employer. Air Hannan requested the S.AI. to treat the matter as a technical offence. On that particular day. none of the certificated engine-drivers employed by Ogilvie was in the yard, and the men stacking timber requested Anderson to drive the locomotive for a few minutes. In addition to employing seven certificate! drivers. Ogilvie himself held a driver’s certificate. Anderson, who was an engineer and fitter, did not hold a driver’s oetrificato, but was well qualified to drive the locomotive. He only did so for a few minutes at the request of the men. Air Hannan therefore asked that the penalty he made light. The S.AF. fined Anderson 10s. with 10s Court costs and 02 2s solicitor’s fee. Ogilvie was lined £l, with I2s Court costs and 02 2s solicitors fee.
