WORDING OF WARRANTY
AN INTERESTING CASE. PAIFJATUA, Hoc. 7. On the interpretation of tho wording of a warranty given in respect of the sale of some cattle rested a claim for £26 10s made by *C. T. Keebh*, Palmerston North, against V. Ebbett, Makomako. in the .Magistrate’s Court to-day. Mr J. Miller, S.M., said it was a ease of contract. The wording “all guaranteed sound in their quarters’ seemed plain. It did not mean sound at some future date, hut- at the time of sale. This clearly brought the onus on plaintiff to rfhow that the rows were unsound on the day of sale. In this ease that was not clearly established. The warranty could not ihe intornre’tod in any other way than that in which it was written. He gave judgment for defendant with costs.
