A claim arising from an accident in which, a pedestrian was knocked down by a motor ear tit Avondale, was heard by -Mr Justice Smith and a jury in the Supreme Court. Hie plaintiff was Sydney Joint -Jones, an insurance agent, ,of Avondale, and the defendant Thomas Myers, a blacksmith, off Avondale. The accident happened oil the evening of May 29, Plaintiff alleged defendant’s ear hat. been negligently controlled in that defendant- had failed to keep a proper look-out, and had swerved at an excessive speed without warning.
