An unusual-assault case was heard before Justices; to-dav, be in g a private action in which William Hermansen. farmer, ~of Maharahara, was charged with halving assaulted Thomas Hanson. The latter said that when he told defendant he was leaving his employ, accused threw Ha/risoh’s gear out of the harness room. He' also picked up a heavy gate hinge, weighing several pounds, and struck him across the r*' r ht arm and then the left arm. Hanson put his hands to his face, to protect himself. Had- lie not done so he ! -would have been struck on the head. He had to go to the hospital for treatment.

Accused* admitted that there had been a scuffle, hut said Hanson struck first, and had .picked up the gate hinge;; and, in getting the hinge away from him, Hanson must have been hit. He. could not account for the manned '-in .which Hanson received his . . .<2 * . i miunds.

The Bench took a serious view af the matter, and convicted and sentenced Hermansen to 21 days’ imprisonment, declining to consider the question of a fine, suspension of the warrant, or the granting of a re-trial.
