<*«- (By Telegraph—Per Press Association. MOTOR REGULATIONS. HAWERA, Aug. 30. A reserved decision which Magistrate Barton announced to-day, upheld a technicality raised by Air A. A. Stewart, counsel for defendant, on a charge of failing to observe the motorists’ offside rule, requiring drivers to give way at intersections to the traffic approaching from the right. Counsel’s contention was that as the regulation specifically refers to intersections not under the control of a traffic officer, the charge must lie dismissed, in the absence of proof by the prosecution that the intersection was not so controlled. 'I he Magistrate explained that it was open to the prosecution to negative that condition by inserting in the Information such words as “the intersection not being controlled by a traffic officer,” but otherwise proof of the absence of control was necessary. The risks to' shunters in failing to obtain a hand grip on improperly sheeted waggons were mentioned in a question to the Minister of Railways by Mr E. P. I.ec (Oainaru). He asked : Has not tbe department been shown a simple design of handrail to which a tarpaulin could bo attached without covering the rail, and if so, will the department adopt the design and thereby minimise the risk to the shunter 1 The Minister of Railways (Mr Coates) replied: There is no necessity for fastening tarpaulins to handgrips on waggons, as special rings are provided for the purpose. If, however, correct methods of sheeting are not observed the handrails on waggons may ho covered by the. tarpaulins. As regards tbe new design,of handrail this suggestion is similar to many others that have been placed before tbe department. It lias given much thought to the matter and considers that if the correct method of sheeting, waggons is observed there should lie no difficulty in keeping handrails free and thus eliminating all risk of accident from this source as far as shunters are concerned. Arrangements have already lieen made to impress upon all concerned the necessity for giving the matter of sheeting waggons special attention.
