(By Telegraph—Per Press Association.) FREE ADVICE CASE. CHRISTCHURCH. Aug. Hi. The Appeal Judges, H. F. Nicoll, U. S. Irwin and L. Cohen have upheld the X.Z. Trotting Association’s reversal of platings in the Free Advice ease and J. Bryce’s license lias been suspended.

The appeal judges met at the Conference office, on Wednesday, August 15th, 1928, to hear the appeal. The club was represented by Messrs V . E. Thompson and B. J. McKenna, and the Association'by Messrs •!. H. Williams and J. B. Thompson. After hearing lengthy argument, tlio appeal judges came to the following decision: (1) That the club in holding that there was a wilful breach by J. Bryce of Rule 289, decided a question of fact under Rule 315, and that therefore no appeal could lie against that finding. (2) That as there was no evidence before the club that Baron Bingen’s ehtaces of winning had been interfered with by Free Advice, the placing of the club of Baron Bingen first and Free Advice second could not be supported and therefore the decision of the Association reversing that placing is upheld.

(3) That as it was decided by the club that the violation of Rule 289 tiy J. Bryce was wilful, his licensq to ride and drive is suspended from this day, August 15th, 1928, until midnight on October 14tb, 1928.

(4) As it appears from tlio evidence that the driving of J. N. Clarke (luring tho progress of the race prior to entering the straight, and before the collision, was open to question, the club bo directed to hold an inquiry into the driving of Clarke.
