Australian Press Assn.—United Service TASMAN FLIGHT. ON SEPTEMBER. Ist. n SYDNEA’, Aug. 2. Captain Kingsford Smith is making a trial flight to-morrow afternoon, when the plane’s wireless will he thoroughly tested. He is anxious for New Zealand to listen in and to ascertain if there will he any difficulty in picking up messages. The wave length is 33.5 metres. The flight to New Zealand will probably commence on September Ist. PACIFIC FLIERS LITIGATION. SYDNEY, Aug. 2. In the application by Anderson against Kingsford Smith (as cabled on July 31st) tho Judge made an order that tlio defendants ho restrained from selling or encumbering the aeroplane “Southern Cross” and that they give an undertaking that tho “Southern Cross” will be within the jurisdiction of the Court al the date for the hearing of the suit; and that notice of its projected flights will lie given to the plaintiff’s solicitor, tho costs of present application to he costs in cause. The Judge refued to make an order than in any future flights by the defendants Anderson should he allowed to take part. He also stated that he would not, at present, make any further order.

Kingsford Smith and Ulm are now free to go ori with the proposed flights to AYcsl Australia and New Zealand. They will probably commence r their flight to AYest Australia on AA’cdnesday next.

Tho date for the hearing of the suit was not fixed, as it is practically certain that evidence will have to he taken in America on commission.
