(Australian Press Association.) SYDNEY, July 20. The case for the prosecution concluded in the charge against Silas Mating. Dr Evatt, counsel for Muling, then submitted that there was no caso to answer on legal grounds, as it was clear that the whole of tho transaction was a portion of trade and commerce with another country, as provided under the Commonwealth constitution. If Arnot’s evidence were accepted, it would be clear that Arnot and Muling would bo guilty of an offence, not under the New South Wales Act, but under tlie Federal Secret Commission’s Act, under which offences were punishable only alter a conviction by a jury. Tlie construction of tlie State Act must of necessity be confined to a transaction within the State. After argument, the Magistrate held that lie had jurisdiction, and that tliore Wti-s u caso to answer. Gwynee Boyd, of the, City Electricity Department, was the first witness for the defence. He gave evidence that he examined the tenders for the Buiuierong contract, and lie had no doubt that the Babcock-AVilcox tender was the best. Mating had at no time endeavoured to influence his conclusion . The hearing was adjourned. QUEEN OF HOLLAND’S ATTITUDE AMSTEDA.M, July 25.
