Reserved judgment was delivered in tiie Magistrate’s Court, Greymouth, yesterday by Mr W. Mcldrum, S * M.■ in itlic ease Smith v. Naylor and Nicholls: “Plaintiff claims from defendants as liquidators £SB 10s, the amount of wages admitted to be duo to him By the Spring Creek Sawmilling Coy. Ltd. up to the time it went into voluntary liquidation. In the case now before me, all that can ho said is that one of the liquidators wants to be sure that there is no superior claim on the assets by the Bank of New South Wales before consenting to pay plaintiff’s claim against the Company for wages. But this is not fraud, mala fkles, or personal misconduct. The mere delay in payment is not enough to create the personal liability. In the meantime the Company is in existence ond the plaintiff has his statutory remedies against it. I do not think in the circumstances, that he has a claim against tho liquidators. Plaintiff is not-suited with costs."
