James Smith, appeared before MrW, Aleldrum. S.AI., at tlic Greymoiitli Alagistrate’s/Court yesterday, in answor to a elinrge that 6u the Cth June last, he did take opossums without lawful authority. The Magistrate, reviewing .the ease, said the evidence was very conflicting. Defendant did not express surprise when the skins were found, but had merely made the remark that someone must have been trying to get one on to him. It is hard to think that anyone would have tried to get him into trouble. The suggestion, I take it. is that whoever reported to the police that lie was bringing the skins in, did so with a view to getting him into trouble. The reports wore made to the police, sufficient for them to make the usual affidavits that they had reasonable cause to suspect that tho skins were concealed in his dwelling house, and the police, acting upon that, found the skins in his The only presumption he could gain from the evidence was that he took them himself, and in my opinion, he is the man who took the opossums, and the evidence is sufficient to enter up a conviction against him. Tie is convicted and fined £4, with 12s costs.and Gs cartage, and an order is made lor the forfeituie of tlie skins.” The Senior-Sergeant quoted the Act, which also provided for the confiscation of the traps. T lie Magistrate said that there was no evidence to prove that the traps had been used out. of season,' and they would ho returned to defendant.
