ARSON CHARGE. GISBORNE, May 31. Following the destruction by fire of a five-roomed dwelling at Ruatoria on Ala.y 17th, two native girls, aged 13 and 17, will appear before the Court next- week charged with incendiarism. The dwelling was owned by Mata Tatimana and with its contents was totally destroyed. YOUNG MAN’S THEFT. CHRISTCHURCH, May 31. James Ford, aged 22, of Kaikoura, was admitted to two years’ probation in the Magistrate’s Court this morning for the theft of C 27 10s, the property of Mrs Thomas. Accused pleaded guilty. The Chief Detective said that accused was the son of the licensee ol ono of the Kaikoura hotels. Mrs Thomas was a boarder at the hotel and accused entered her room and stole her bag.

The appeal by the Pukemiro Collieries Ltd., against decision by Ah Wyvci n Wilson, S.AL, in the ATugistrate’s Court in Huntly. has been disallowed by the Arbitration Court. A reserved decision lias been given by Justice Frazer affirming the judgment of the Lower Court, and allowing £•*, 5s costs to respondent union. Pukemiro Coal Aline Workers Union, appellants, as plaintiffs in the Lower Court were non-suited on ,n point of law in an action brought against the Pukemiro Coal Aline Workers Industrial Union for recovery of C2CO as a penalty under the Labour Disputes Investigation Act. for a breach of the working agreement. The breach in question according to the original statement of claim consisted in the loss ot two working days, as the result of the holding of stop work meetings called liv officials of the union.

The grounds on which the Alagistrate had granted a non-suit were that there was no liability for a penalty unless the working agreement between tiie employers and employees had been tiled with the Clerk of Awards. This had not been done, the interpretation placed on the clause being that registration was a voluntary matter in tlie Arbitration Court, before it could decide as an actionable breach of an agreement'. That had not been filed, and it had to lie satisfied that the language of the section clearly indicated that such an agreement was enforceable under the provisions of the Act. The Court was not satisfied on this point and the appeal was accordingly disallowed.

Geo Johnstone, son of a farmer near Kawakawa, was accidentally shot yesterday morning. He was taking cream to a collecting stand, and when removing the can, a gun which he was carrying exploded. He was removed to Kawakawa Hospital where lie died last night.

Eire destroyed a house and shop Li Sea.vh.nv Road, Brighton, early this moriiing. The tenant, Airs J. Carney, had a narrow escape. She was awakened by smoke and had to jump from a verandah, injuring her back. She is a widow of the late Detective Carney.

The plaintiffs were Parker and Jones, Ltd., Christchurch, timber merchants, and the defendant. William James Alorris, Reef ton. sawmiller. The case came up in the form of motions for order by the court. The main items in the dispute arise in consequence <»l the plaintiff company going into possession of defendant’s mortgage, on account ot defendant’s alleged failure t« _ observe the terms of the mortgage. The Hiliemoa. which left Auckland on Alay 9th has arrived at Leper Island. She encountered very had weather and was hove to during a gale on Alay 13th. Her decks were flooded. Considerable damage was done to deck fittings. One big sea shifted the hedge anchor, weighing over a ton. from its lashings, and carried away the figurehead and flooded the seamen » quarters, there being three feet of water in the forecastle during the gale. She was detained two days on the voynge to Rarotonga on account of the gale.

CAR. WELLINGTON, Alay 31. . Airs AY. AVnrd was knocked down last night by a motor car and hospitalled with a fractured skull. Her condition is serious. To-dav Gulio Nervi, an Italian fisherman was charged with being intoxicated in charge of a car and also causing Airs AVaid’s injuries. He 'as remanded till Btli of June on bad.
