MAGISTRATE’S AWARD UPHELD CHRISTCHURCH, April 27.
Because the use of tract ion engines on public highways is not. specially covered by statute, and bolding that their use in the absence of statutory immunity, is subject to a common lawliability, which is independent of negligence, lor fires caused by sparks from traction engines. Mr Justice Adams in the Supreme Court to-day dismissed an appeal against a Magistrate’s decision, allowing damages lor a fire in a hedge, presumably the result uf sparks from a traction engine.
The appellants were Frew and McCrostie. haulage contractors, and the respondent was John Donald Stewart, farmer, of Norwood.

CHARGED WITH RAPE. MASTKETON. April 27. Walter Scott Baby, a jockey, was -barged in tin.* Magistrate’s Court to:lay with having on April 1 L at Masterton, committed rape on a Maste--ton girl, aged 18.1 years. The court was tloured during the hearing of the evidence.
The offence was alleged to have taken place at the rear of the Central Arcade, while a dance was being held in the hall.
Complainant stated that she did not offer accused any encouragement to act in the manner in which lie did. -Several witnessc were called for the defence. with a view to a rebuttal ol complainant’s statement regarding the time alleged of the offence and attendant circumstances. CHEQUE FRAUD. WELLINGTON. April 27.
