\t the Magistrate’s Court this afternoon Mr AV. Meldrum S.M. gave bis reserved judgment on the case heard at the morning sitting in which the AVestland Hospital Board sued Charles Dennison (Mr Murdoch) for £7l 2s, moneys alleged to tie due for maintenance of his son at the sanitonum arid'for treatment of his daughter and wife at AVestland Hospital. His AVorship said it was not denied that *- fendant was the parent or husband respectively The question was whether the father was liable. There was no evidence that he had contracted to pay the Board, which had proceeded under the Destitute Persons Act. He ruled that the action was not properly taken to begin with, in the absence of an express agreement »v the father, while a clause in the Act stated the proceedings must bo taken with the approval of the Crown and there was no proof that this had been given. The Board’s bye-laws did not cover anyone except the person who had received the treatment. Under the circumstances he could do nothing but nonsuit plaintiff.
