.Mr E. C. Page, S.M. gave a reserved judgment at Weilingtbn yesterday in the case of the Police v. Cecil William Price, an auctioneer, who was charged with selling liquor without being duly licensed. This is a case of defendant selling liquor while acting as auctioneer for the Railway Department in a sale of unclaimed luggage. The defence was that he was tile agent of the Crown and therefore immune. Mr Page upheld this and dismissed the information. The Licensing Acts, said Air Page, contained no statement that the Act was to he binding on the Crown, nor was there nnv necessary implication to that effect. Ho also said that in practice, liquor was for many years sold at railway refreshment rooms, but the premises were not deemed to be within the jurisdiction of licensing committees, and no licenses were ever issued. Apart from the immunity attaching t> the Crown and its agents, section f ’ x the Government Railways Act gives express power to sell any goods left on the premises of the railway. Costs were not allowed, the ease having been brought bona fide by the police.
