MOTOR COLLISION LITIGATION. WELLINGTON. Sept. S. Mr Page gave reserved judgment in tlie -Magistrate’s Court on J. D. Wiiliams’ claim for £4!) damages from H. S. Menzies, the result of a collision between two cars in the Hutt Road on February 23rd. Menzies counterclaimed for £9O. Both cars were travelling towards Wellington, and plaintiff decided to go up Khandallah Road. The defendant, who had been following, had just prior to this move sounded his horn, and moved up to the right, with the intention of passing the other car. Plaintiff’s car was at right angles to the line of the road when the two cars came into collision. The Magistrate held that plaintiff made the turn when there was no reasonable prospect of doing it in safety, and without giving adequate warning. ITe awarded defendant £2O on the counter-claim.
