Saturday's “Diiniinioii” comments— Tho public stuiso of justice will bo shocked by the mildness of tile sentences imposed by His Honour, Hr •I list ice ltd’ll on the men. Stacey and Harper, convicted of responsibility for the motor fatality on the Hutt Hoad, which resulted iu the untimely death df Henry Brian Kenny. There was not a single mitigating cireuin.stanco in the _ca.se. The men stole the car from a stand in a city street. They drove it recklessly and at excessive speed along the Hutt Hoad, breaking the law and threatening danger to traffic. Ultimately they swerved right across this wide thoroughfare on to the wrong side of the road, crashed into a service’.ear, killing the driver and injuring -passengers and .smashing up two ears. They might just as easily have killed half a dozen people as one. If over there was a ease calling for an exemplary sentence this was one. Yet His Honour allowed Stacey, the chief offender, to escape with a twelve months’ sentence, and Harper, whom the jury had recommended to the mercy of.the Court, with nine months. It is impossible to follow His Honour's reasoning for bis summing-up to the jury admirably set out the facts, and the implications to be drawn from the facts. Ihe public who expect protection against such outrages, have everv reason to feel concern over the view taken by the Court of the gravity of the crime comitted bv these men.

Butter from the same churning as that which tailed to secure a place at the recent Dunedin W inter Show was taken to Attekand, and was awarded the New Zealand championship tit the Auckland Winter Show. The - 'ledaction front this interesting fact Is that cither the judges have a different idea as to merit, or the South Island product is infinitely superior to that o'f the. North Island (remarks the Dunedin “Star”). Another .sample front the same churning secured first place at the Waikato Winter Show, but similar blitter wa.s graded only fourth at the Sydney Both! Show. When butter that wins the New Zealand championship can secure only fourth place in Australia, it b dear that the 'Dominion has now a formidable rival in lie Commoiiwoalh.

A motorist whose car Hit a dog and then overturned, with the result that it was damaged and its occupants were injured, was awarded £sl 12s damages and CIO 17s Gd costs in the Magistrate’s Court at Napier a. few days ago'. During legal argument it was stated that: the case was the first ot its kind in New Zealand. Counsel for the plaintiff cited a recent decision by a New Zealand Magistrate that the New Zealand Act applied to any injury that the dog might inflict. A dog was an animal that must ho kept under guard or prevented lrom doing damage. Counsel contended that the common law of England, which said that before it was .possible to get damages for an act of a dog, it was necessary to prove negligence cn the part ol the owner, had now been modified by the Statute Law. The Magistrate (Mr A. Af. Mowlem) said he did not con. siilt-r that the plaintilf wa.s negligent or that he contributed to the accident. He gave judgment tor the full amount claimed, comprising TAG 12s for repairs and medical expense, and £ls for general expenses.
