AVhtttex Constitutions. The High Court of Australia lias decided unanimously that the action of the New South Wales legislature in levying a tax oil newspapers is “ultra vires.” The tax is in effect an excise duty, and as such can he levied only by the Commonwealth Government. Mr Lang is therefore defeated in his attempt to utilise the State fiscal machinery for the purpose of inflicting financial injury upon some of his most dangerous political adversaries. The fact that, on his own admission, he had been warned hv his Government's legal advisers that the tax was unconstitutional. renders his action even more reprehensible and contemptible than if he had believed in its soundness himself. —Auckland Star.
