interesting court case. AUCKLAND, March 0. A case connected with the training of two racehorses was heard in the Hamilton Magistrate's Court yesterday. Michael John Carroll, trainer, Frankton, sought to recover from Alfred Newton Dingle, farmer, Gisborne, £32 15s, training fees with respect to the racehorse Forest Gold and a Nassau fiilv.
Plaintiff said that he trained both horses for defendant. The filly was highly strung, and would not stand up to track work, so he used her as a hack. She was grazed in a paddock for two weeks and given light work. Forest Gold was properly trained, and Was raced unsuccessfully at Avondale.
Defendant said that, on seeing Forest Gold at Avondale, he was dissatisfied with 'his condition. Both horses were so neglected and poorly trained that he took them away from the plaintiff and refused to pay the training fees demanded.
The Magistrate held that Forest Gold was undoubtedly in a neglected and unclean condition, and that his value and usefulness as a racehorse must have deteriorated. When the animal was placed with another trainer it immediately brightened up in condition and ran a creditable race. As far as the filly was concerned, the horse had been turned out for some time and became fat and soft. It was not trained as a. racehorse, but was thrown out without the knowdedge of the owner. Judgment would be given for defendant in both cases, with £lB 7s costs.
