Air Murdoch for defendant pleaded guilty. Sorgt. King slated that two men came to Hokitika. with a truck load of apples which they proceeded to sell in the residen tial part of the town. In one instance a case was sold at 11s fid and when the case was opened the top-layer was lottl'd to lie good and all the others in a rotten state. A request to the seller for a good ease or return of the amount paid was agreed to. hut the seller failed to give effect to the promise. A number of other eases of apples sold were in a similar condition. Fined £2 and costs 10s, and the price of the ease. 11s fid, to he also refunded to the buyer.
