RULES OF THE ROAD. N'EW PLYMOUTH. Feb. 17. A neat point concerning the rules of the road was raised in the Supreme Court to-day in an appeal bv John Fary against the decision of Mr Tate, S.M.. at. Eltham Court. A collision occurred, and both drivers were held as negligent. Fary appealed to-Jay and Mi- Justice Ostler reversed the decision of the lower court, allowing the tippoll ant ten guineas cost. The chief reason for the non suit for Fary was that lie had crossed the “intersection” at a greater speed than P2 miles contrary to the by-laws. After consulting the dictionary, the Judge decided that as the road joined another without crossing, it did not constitute an intersection, and that Fary’s speed of 25 miles was not unreasonable if he took all precautions.
