At tho lleefton sitting of the Arbitration Court ji eomtpensation case, Samuel Eastgato v. Hlackwater Mines, was taken on Friday. The statement of claim alleged that while in the employ of the company, and while replacing a loaded truck on its rails at the Blackwater mines on January 12, 1926, plaintiff suffered injuries to his heart, which have since caused him to remain totally disabled. The company denied liability, and also denied that plaintiff suffered injury as stated. Lengthy evidence was given by plaintiff, Dr Conlon, Dr Church and R. A. Stewart, mine manager. His Honor in announcing judgment stated that the medical evidence showed that the lift had not affected the heart, as plaintiff would be enabled to do light work, and at his age a certain amount of deterioration had set in. Plaintiff had suffered a muscular sprain and had suffered an accident within the meaning of the Act. Judgment was entered for the compensation claimed, £lO2, solicitor’s fee £8 Bs, witnesses’ expenses per Magistrate's Court scale and medical expenses per scale.
