APPEAL COURT.
WELLINGTON, June 29. The Appeal Court is engaged hearing the case of Alex Dunn of "Wellington, solicitor, against Harry Mandell of Wellington, seaman, which involves a point of law of great interest to mortgagees of property. Maudell was injured ou the steamer Huia in 1920 and obtained- judgment in "Wellington in 1923 for £316 'and costs against one, Williams, the purchaser of the ship under agreements. A\ ilHams afterwards became bankrupt niul left New Zealand. Dunn had three mortgages on the vessel amounting to £9OOO The question ‘arose as to whether Maudell’s claim took precedence over tlie mortgagees and Judge Ostler found that it did. Against this decision Dunn appeals. Air Foden and Air Burton for appellant, Air O’Regan for respondent.
