At the .Supreme Court a charge of contempt of Court in failing to make an .'application for discharge from bankruptcy, after having been notified by the Official Assignee, Leslie Roy King, a farm labourer, was committed to prison for fourteen days. TRADE MARK LITIGATION. WELLINGTON, Juu c 9. The use of the word ‘•laddcrproof” as a stockings trade mark was disallowed by tiio reserved judgment of Chief Justice Skcrrett, to-day, on an appeal by a number of soft goods importers throughout New Zealand from a decision by the Registrar of Trade Marks, allowing, a registration in the name of George A. Bond and Coy. The grounds of the objection were that ''Laddcrproof’ was not capable of distinguishing goods of applicants ; the proposed mark had not been used upon, or in connection with, goods in such manner as to indicate that they wore tlic goods of applicants ; that the word was in common use by manufacturers to indicate a peculiar quality of manufactured article, and in no ease was it distinctive of the goods of any particular mahuiactufer. His Honour found that the word “Laddcrproof” was not in fact used by applicants for the purpose of indicating their goods as distinguished from other manufacturers, and that the primary meaning of the word had not in the New Zealand hosiery trade acquired any distinctive meaning denoting the applicants’ goods The appeal was allowed, and the allowance of tl:e registration was voided. At the Magistrate’s Court at Otautau, Frank Harry Francis, ex-Postmas-tcr at O taut an, was charged with the theft of various sums, the largest of which was £IBO, over a period ol two years. The accused was arrested at Raugiora in May, when, in a statement to the police, he admitted the thefts. He s'aid the money'was spent in drinking and gambling. The police said that Francis had given every assistance in clearing up the matter. After evidence was heard, the accused pleaded guilty to all the charges and was' committed to the Supreme Court for sentence. INCEST CHARGE. At.the Supreme Court, a well-known farmer at Rototunn, Herbet Gotliorpe, was acquitted on a charge of incest.
