CHIEF JUSTICE’S DECISION. WELLINGTON. June 2

A reserved decision of the Supremo Court declined to give a declaratory judgment in the matter of questions put by the Dairy Proprietary Association and Waikato Dairy Coy Ltd in regard to the powers of the Dairy Produce Control Board. In the conclusion of the judgment the Chief Justice says our decision places no real difficulty in plaintiff’s way. They can obtain a decision of the Court upon any action contemplated hv the Board which they claim to contravene their rights, in the action claiming a declaration of rights and injunction they cannot, however, in such an action as the present, obtain tlie opinion of the Court oil the interpretation of substantially all the provisions of the Statute.

Ernest Thomas Read was charged with a breach of the Marriage Act by making; a false declaration regarding his age, stating he wa.s 31 when 40. He married a girl whose age was given as 16. He was found guilty and was committed for .sentence.

OBJECTION TO LICENSE. AYANGANUI, June 2

The licensing bench was engaged today hearing an objection by the police lo the way the Commercial Hotel had been conducted; The proceedings were taken under section 190 (I) of the Licensing Act. The objection was that the house was conducted in an improper manner, drunkenness permitted therein and that during part of February, 1926, .and from about April 26th to May 12th, one, William Stevenson, lodged at the Commercial Hotel, handed over a large sum of money to the licensee in advance for liquor and lodgings to he supplied; that he received lodgings, was supplied with intoxioating liquor and was frequently in a state of intoxication and drunkenness. Stevenson alleged that he handed over three sums of money of £SO to the licensee. These were cut out between the above-mentioned dates. The hearing is adjourned.
