Plaintiffs therefore claimed damages as follow: Coal illegally removed. 1409 tons, £1109; coal rendered useless, 609 tons,

£4SO; cost of installing new pumps to cope with water, £56 10s; cost of survey. £23 13s. cost of pumping. £l4O 2s' (id; to reduction in output from plaintiffs’ mine through illegal trespass, £100; damage from water, £4160: total damages claimed. £6120. Mr IV. J. Joyce appeared for Boote and party, and" Mr I. Patterson, for Armstrong and party. Damages were allocated as follows :—For coal illegally removed, £1169: coal rendered useless. £480; cost of survey. £23 13s; damage by water, £340; total £2OOB 13s.

Each party was ordered to pay its own costs.
